"Although workers relinquished, historically, their right to sue employers for damages, they never relinquished their right to dignity." - Katherine Lippel, Professor of Law

POLITICIANS WHO TAKE ACTION
FOR INJURED WORKERS

Did you know that as soon as you are injured at work
YOU ARE NO LONGER COVERED UNDER THE CANADA HEALTH ACT!?

The Canada Health Act states:
" "insured health services" means hospital services, physician services and surgical-dental services provided to insured persons, but does not include any health services that a person is entitled to and eligible for under any other Act of Parliament or under any Act of the legislature of a province that relates to workers' or workmen's compensation;"
( see: http://laws.justice.gc.ca/en/C-6/ )

At that point, you are totally at the mercy of your provincial workers compensation system
to provide your health-related needs.

But what if they say "NO"?

What if the workers compensation system denies your claim?

The reality for many seriously injured workers is that they are subjected to lengthy appeals processes by the workers compensation systems and then, if their claim is still denied, they cannot sue the WCB or their employer and are left to fend for themselves and their families without any support.

Injured workers across Canada are scraping to find money for medications and treatments when their workers compensation board either denies their claim, under-compensates their claim or cuts off their claim prematurely.

How would you feel having to choose between your medications, your rent or food for your children?

This situation is not an exception. As workers compensation boards save money by denying claims, injured workers and their families suffer.

The CIWS believes that workers compensation boards are failing in their mandate to supply workplace injury compensation, are denying legitimate claims and are terminating compensation prematurely. We are here to voice those concerns and take action to promote fairness in workplace injury compensation across Canada.

To do this, we are collecting stories from injured workers to use as anonymous case examples of misconduct by workers compensation boards across Canada.

We will NOT reveal your name without your express permission.

If you want to report any misconduct by your workers compensation system to the CIWS, please email us at

We do not handle individual cases but will use your case as an example. This will be done anonymously. We will NOT reveal your name without your express permission.

Please do not write asking for advice with your claim. We do not have the resources to answer specific questions regarding your claim. For peer-to-peer support, you can register at the Community of Injured Workers in Canada where other injured workers may have advice for you or experience with your specific situation in your province.

We are especially interested in hearing about possible cases of:
- falsification or removal of medical evidence or other documentation
- biased medical reports
- intimidation, surveillance or harassment
- inappropriate medical or psychological evaluations
- verbal or physical abuse of injured workers by workers compensation employees or medical staff
- fabrication of false information about you by anyone
- unfulfilled court orders or Appeals Commission orders

REPORT MISCONDUCT by your workers compensation system to:

We do not handle individual cases but will use your case ANONYMOUSLY to document our
list of WCB wrongdoing

The CIWS is collecting evidence from injured workers about their experiences with workers compensation boards across Canada.

We are compiling anonymous evidence to list WCB wrongdoing and to support our call for a

into Criminal Code and Charter of Rights violations by
workers compensation boards across Canada.
